Some members of the US Congress have\u00a0<a href=\"https:\/\/zeteo.com\/p\/exclusive-you-have-been-warned-republican\" target=\"_blank\" rel=\"noopener noreferrer\">threatened<\/a> to retaliate against the\u00a0International Criminal Court (ICC), including by\u00a0<a href=\"https:\/\/mast.house.gov\/2024\/5\/mast-roy-lead-gop-push-to-sanction-international-criminal-court-for-targeting-israel#:~:text=As%20part%20of%20the%20sanctions,visas%20revoked%20and%20face%20deportation.\" target=\"_blank\" rel=\"noopener noreferrer\">imposing sanctions<\/a> against court officers, if the court moves forward with arrest warrants against Israeli officials in its Palestine investigation.<\/p>\n<p>In an <a href=\"https:\/\/www.npwj.org\/wp-content\/uploads\/2024\/05\/Joint-NGO-Letter-to-President-Biden-on-the-International-Criminal-Court.pdf\">open letter<\/a> issued today, <strong>121 human rights and\u00a0<span class=\"onomasticon onomasticon-cursor-default\" tabindex=\"0\" title=\"civil society\" data-tooltip=\"Civil society usually refers to a broad array of nongovernmental organizations including: community and grassroots groups, advocacy organizations, religious-based groups, labor unions, and many others. Civil society typically does what the government or businesses cannot or won\u2019t do, such as providing direct services or advocating for changes in the laws and government practices.\" aria-label=\"Explain glossary term civil society\" data-once=\"enable_tooltips\">civil society<\/span> groups<\/strong>, including <strong>No Peace Without Justice<\/strong>, call on <strong>President Biden<\/strong> to oppose threats and calls for punitive actions against the ICC.<br \/>\n&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>President Joseph R. Biden, Jr.<br \/>\nThe White House<br \/>\n1600 Pennsylvania Avenue NW<br \/>\nWashington, D.C. 20500<br \/>\nRe: Threats to the International Criminal Court<\/p>\n<p>Dear President Biden:<\/p>\n<p>We write as organizations with a steadfast commitment to justice for grave international crimes<br \/>\nand therefore to the success of the International Criminal Court (ICC). We urge your<br \/>\nadministration to oppose the threats and calls for punitive actions against the Court that several<br \/>\nU.S. lawmakers have recently made. Acting on these calls would do grave harm to the interests<br \/>\nof all victims globally and to the U.S. government\u2019s ability to champion human rights and the<br \/>\ncause of justice, which are stated priorities of your administration.<\/p>\n<p>Accountability is important for its own sake and protects against the commission of future<br \/>\natrocity crimes. Acting where it has jurisdiction and within its mandate as a court of last resort,<br \/>\nthe ICC works together with national authorities to ensure perpetrators of such crimes are held to<br \/>\naccount and that victims and affected communities find some measure of justice. While the<br \/>\nUnited States is not an ICC member country, Republican and Democratic administrations have<br \/>\nsupported the Court in specific cases, and the U.S. has assisted arrest operations to bring justice<br \/>\nto victims in central Africa. Your own administration has recognized the Court\u2019s essential role to<br \/>\naddress serious crimes in Ukraine and Darfur.<\/p>\n<p>We are alarmed by threats that U.S. lawmakers have aimed at the Court in recent weeks<br \/>\nincluding the letter sent on April 24 by Senators, threatening to sanction the ICC prosecutor\u2019s<br \/>\n\u201cemployees and associates,\u201d if steps were taken to pursue arrest warrants against Israeli officials.<br \/>\nOn May 20, the ICC prosecutor requested warrants for leaders of Hamas and Israeli officials<br \/>\nstemming from his ongoing Palestine investigation; ICC judges will assess the request to<br \/>\ndetermine whether to issue warrants.<\/p>\n<p>The previous administration\u2019s sanctions against the prosecutor\u2019s predecessor were an affront to<br \/>\njustice and threatened to undermine the ICC\u2019s effective functioning. A U.S. federal district judge<br \/>\nheld that the sanctions threatened the First Amendment rights of U.S. citizens working to support<br \/>\njustice before the ICC. Regrettably, those sanctions aligned the United States with authoritarian<br \/>\ntactics of threatening judges and independent judicial institutions.<\/p>\n<p>The ability of the ICC to provide justice for victims requires full respect for its independence. A<br \/>\nselective approach to judicial decisions undermines the credibility, and ultimately, the force of<br \/>\nthe law as a shield against human rights violations and abuses. Your administration appeared to<br \/>\nrecognize this in repealing the Trump-era sanctions, noting that U.S. concerns \u201cwould be better<br \/>\naddressed through engagement with all stakeholders in the ICC process.\u201d We urge you to ensure<br \/>\nthat any disagreement about the Court\u2019s process is pursued through proper judicial channels<br \/>\nunder the Court\u2019s treaty.<\/p>\n<p>We welcomed press statements by your administration in recent weeks indicating that it does not<br \/>\nsupport \u201cthreats or intimidation\u201d of ICC officials. U.S. allies have condemned the threat of<br \/>\nsanctions and expressed support for the Court, as have 45 United Nations experts on human<br \/>\nrights in a joint statement.
