“Continuity by Consensus: Keeping the Choice with the States Parties” is No Peace Without Justice’s response to the ASP President’s Options Paper on the election of the fourth Prosecutor of the International Criminal Court, prepared in reply to the President’s invitation for written comments.
The paper urges States Parties to keep the choice of the next Prosecutor in their own hands and in the open. It favours a consensus on one of the serving Deputy Prosecutors, already elected, vetted and leading the Office, for a full term and within whichever process the Bureau adopts. Failing consensus, it calls for a direct election by secret ballot, as Article 42 of the Rome Statute prescribes. It cautions against reviving a closed expert committee that would filter candidates out of public view, where a choice made under pressure could not be told apart from one made on merit.
